Using LEED NC (BD+C v2009) for a tenant situation

We chose to register our project under LEED BD+C New Construction (v2009) as the building will be undergoing substantial renovation. However, this is a tenant situation. 1.

I have a project that is undergoing discussion regarding which rating system to use. For all practical purposes, it is an interior fit-out of 4 floors of a hospital tower for a new unit.
