Owned or leased?

NC-2009 PIf3:Occupant and Usage Data

My project is a LEED NC 2009 building that is operated by a company different of the owner. I am just wondering if populating the PIf3 with "leased" will bring me problems during the review.

If our project's BAS controls 100% of the building's heating and air conditioning, but only 35% of the building's ventilation (by square footage), can we still pursue this credit?
