Spaces exemption for IEQ c4.1 - 4.4

I heard from someone that IEQ c4.1 - 4.4 only apply to indoor regularly occupied spaces. Is that true? Is there any spaces exemption for these credits?

Will there be a change in code for the baseline? Currently, LEED 2009v3 is using Appendix G of ANSI/ASHRAE/IESNA Standard 90.1-2007, will 2012 jump to 2010 for baseline?
