Eddie, according to the credit language (see above), you simply have to use MERV 13 filters prior to air being introduced to occupied spaces. So I don't see any problem with your situation.

Tristan is correct. This complies and is actually a very typical situation. The pre-filters are there to lengthen the life of the more expensive MERV 13 filters.
