Filtration Media MERV 9

Is filtration media MERV 9 allowed during construction?  This is in addition to the MERV 8 filters for the AHU's.

We have a project where a heavy drill will be drilling micropiles in the basement. It is going to be a diesel powered drill, and it will make a heckuva lot of fumes.
