Would a 5 story multi family apartment building follow LEED NC or LEED for Homes? Is there a specific document the USGBC provides that clarifies this? Thanks in advance.

Yes, see the LEED rating  system selection policy. Off the top of my head, I would guess you're in LEED for Homes Mid-Rise.

after I posted this question I found the USGBC's Rating System Selection Guide and on page 11 it states that 4+ story multi-family buildings with separate HVAC systems can use either Homes or NC...am I reading this correctly?
