We are a Canadian company that has separate Commissioning and TAB divisions and have provided/are providing both of these services on about 2 dozen LEED projects. We feel that the Owner gets a better building when we provide both services because we can ensure that TAB gets the time it deserves (instead of having TAB be compressed as it often is.) However, we often get the question of whether there is a conflict of interest when we provide both services. I can't find any CIRs or definitive answers to this question, can anyone provide any information on this?

I don't think LEED perceives a conflict of interest here. The key point is that the CxA for LEED projects over 50,000 ft2 has to be independent of the design and construction management. If you would consider TAB independent of these as well, then you're fine.
