Here is an interesting potential case I was asked about:
A company is considering pursuing LEED-CI for occupancy on the upper floors of a 10 story building. There is a ground floor night club on the premises that permits smoking, and the operating hours are after 6 pm and weekends (i.e. minimal if any occupants in the general areas of the building). If the club space is sealed well but NO local exhaust/negative pressure is provided, what are the odds that GBCI will rule favorably in a CIR? The key element is the after-hours operation of the club.

George, this situation seems to fall under Option 2 for IEQp2 in the LEED-CI rating system.I would say you have a slim chance of complying using this approach, but the credit language seems to call for negative pressure via mechanical ventilation, so it's very possible that GBCI won't give ground on that.
