Clarification regarding domestic electric water heaters

Hello everyone,

We have a ID+C project outside the US, and client wishes to purchase a electric tankless water heater (www.termotronic.com).

It is about 11,000 W rated power and 99% efficiency. However, we are not sure if it is indeed eligible for Energy Star or not since there is a category for water heaters; that is, should we include it in the calculations for EAp2 credit as "Non-ENERGY STAR Equipment"?

Reviewing the ENERGY STAR® Program Requirements - Product Specification for Residential Water Heaters - Eligibility Criteria Version 1.1, item 2)B., it does state that Electric resistance water heaters are not eligible for ENERGY STAR.

It is not eligible for Energy Star since they do not have a category that covers it. It is not included as "equipment" either since it is regulated by 90.1 as a separate end use under service hot water.
