We've got a building and hardscape located more than 50 feet from a navagable body of water, with one exception. There is a paved road to a dock that is on the body of water. The purpose of this building is shoreline maintenance (this is a major recreational lake and the building is owned by the lake authority) so a dock is part and parcel to the purpose of the building. Do you think we have a shot at "Special Circumstances" or "Alternative Compliance"? It complies with the letter of all the other requirements in this credit.

The credit language seems clear to me that building a road within 50' from a water body wouldn't meet the requirements, but if you disagree, it might be worth asking GBCI through the Contact Us form on the USGBC website. If the road isn't built already, would you be able to extend the dock structure to the 50' line and shorten the road? That seems to me like a solution that would better meet the credit intent, given the potential difference in the impact on a habitat between a dock and hardscape.
