Two parking clarifications

1. Does "provided" mean no charge to an occupant who is parking in a spot (i.e., parking is included in the lease) or merely that a spot is allocated/reserved for a particular tenant? In my project, there are very few spots included in the lease, but other occupants can still pay for parking on their own if they so desire. 2. In a large multi-tenant building, must the car/vanpool spots be allocated to a tenant, or merely installed for all building occupants? In my project, there are plenty of car/vanpool reserved spots, but none are allocated to a particular tenant.

Jared, I would say that provided can be either definition that you provide.I would say that the vanpool spaces do not need to be allocated, but if they are not allocated then they need to be present in sufficient quantity to meet the credit requirements for the whole building.

Regarding "provided" it may depend on your exact language. I would say if the lease states how many spaces are available to the tenant, then those would be the ones "provided." If there's an option to pay for parking that anyone can use (i.e. someone coming to that location to shop in neighboring buildings, etc.) then I would say it those spots are NOT provided to the tenant. But this may depend on your specific situation / set up. (Are the pay parking spots that are available any different from paying for parking on your own in a neighboring lot?)
