We are working on a speculative 1,000,000 SF industrial warehouse which is pursuing a LEED CS. Since the future tenant is not determined yet, the core and shell scope only includes one bathroom with one toilet/sink/shower mainly for maintenance purpose at this time. Can we comply with WE p1 with LEED interpretation #10214? Or do we need a binding lease agreement that the future tenant will complete the build-out with 20% more efficient plumbing fixtures and fittings?

Yes, but our client, a developer, prefers to do without a binding lease agreement if possible for the obvious reason. However, It sounds like there's no way around it if it's a spec building with no signed on tenant at the moment, correct?

Joann, LI #10214 explicitly says it is not applicable to CS projects.CS Appendix 4 gives you two choices, which I think are what you are left with.My two cents—why is the developer bothering with LEED if they don't want to commit to efficient practices? 20% improvement is not hard or expensive.
