Which is the HVAC load installed by tenant owner's or tenant's?

The HVAC load in alternative path in LEED 2009 CS are counted as owner's load according to the instruction of two examples in "EAp2_TenantOwnerLoadAdjustment.xls". However, in case of HVAC systems installed by tenant, can I count it as tenant's load to calculate the percentage of energy cost controlled by owner?

Anything installed or influenced by the owner/developer counts toward this percentage. The HVAC in the tenant spaces typically counts as influenced since the building envelope affects this energy end use. Typically the only energy end uses not controlled or influenced tend to be the lighting and plug loads within tenant spaces.
