NC-2009 EAp2:Minimum Energy Performance

Baseline HVAC Selection

We have a 5 story non-residential building (located on a campus), with a mechanical penthouse (with roof) above. We are trying to determine if this would be a 6 story building versus a 5 story with a penthouse. The total s.f. is less than 150,000. This determines if we use the baseline system 5 or 7. Can anyone help answer which system GBCI would compare us to? We interpret that we would consider this a 5 story +penthouse, but the penthouse is rather large, and does have a roof on it. Any advice?

The language in 90.1-2007 is not entirely clear on this, as "floor" in this context is not defined. I would argue that it is a 5-story building with a penthouse, unless any part of the penthouse is regularly occupied. I would also take a look at whether your local building code considers this an occupied floor.
