CS-2009 EAp2:Minimum Energy Performance

Tenant Scope, Owner Scope, Tenant Guidelines

I'm sure this questions has be asked before, but I cant seem to find the answer. Do forgive me if its repetitive. Where is the line between tenant scope, owner scope and the Tenant Guidelines? For example, the owner on our project intends for tenants to be responsible for the installation of insulation and sheet-rocking the walls of each of their spaces. The owner will only provide the raw space. But without insulation as part of the CS energy model I cant imagine meeting EApr2. Is it possible to submit the tenant agreement to a particular level of insulation as proof of compliance? For which prerequisites/credits can the Tenant Agreement be used to document work that is not part of the owners scope? thanks so much!

CS Appendix 4 ?? Is that in the Green BD&C Reference Guide?

I'm currently working on a CS v3 project where the owner wants to put plumbing and HVAC work in the tenants' hands. I have 2 questions about CS Appendix 4: 1 - What is the significance of the different "Case" designations? It does not appear that we must only select one case.. right? We would like to use the lease agreement for several prereq's and credits under different "cases"... is that possible? 2 - Under "Case A", we are allowed to write requirements into the lease for EAp2 and EAc1, but EAc1 has "(performance path only)" written next to it. EAp2/EAc1 each have 3 options to choose from: one "whole building energy simulation" and two "prescriptive compliance" paths. One of the "prescriptive compliance" paths references the "Advanced Buildings Core Performance Guide"... Since CS Appendix 4 actually says "(performance path only)", as opposed to "(prescriptive path only)", does that mean we are limited to Option 3 only? Also, Options 2 and 3 provide the opportunity to gain 1-3 points... is this kosher since we are supposed to get a minimum of 2 EAc1 points? Thanks for any insight you can provide!

Q1 - The credits are classified unto the different case designations. Some credits look at shell and core only, other look at the whole building, while a few can go either way. Your project will have credits under all three cases. Q2 - "performance path" = "whole building energy simulation" (that language is a little confusing) FYI - Under v2009 the two point minimum no longer exists. The prerequisites have been modified to require performance beyond code.
