Scott, a couple of questions to clarify.
What is "now"? If I understand you, and I want to check, construction is complete and you're working on your construction submittal.
Could you give a specific example of the kind of threshold question that you have?

Yes, we have completed the design submittal and have 33 points, a very good start! That was maybe a year ago or so. This is a very large project, hense some extended timelines.
Now we are nearing the end of construction and should be doing the construction submittal in the fall.
As with any project, the owner is decided to complete some additional space now while the contractors are on site.
In a way, this would really represent a typical project. With a divided submission, there can always be changes in the project before completion. We have reviewed this, and see no affect on the overall LEED credits (especially the energy modeling since in modeled a totally occupied building), but wonder if anyone else has encountered this situation.
