If a dedicated smoking area is on the rooftop of a buildng and there is an operable window on the floor below, does the distance between the smoking zone and the window has to be 25 feet? (or said differently : does the distance count in both horizontal and vertical directions?)

Let's think it through—I have an office on the top floor with an open window, maybe a fan blowing in on my face. Six feet up from the top of my open window, someone is leaning against the railing of the roof terrace puffing their cigarette. Do I get a face full of smoke? You bet. Does LEED care? Definitely.
