proposed energy savings for unfinished spaces based on local energy code?

Nowadays, many local energy codes are exceeding LEED's ASHRAE 90.1-2010 Baseline.  Has anybody successfully claimed energy savings for unfinished tenant spaces based on local code?

I thought I recalled reading that the HVAC energy related to a commercial kitchen hood was considered Process Energy.

The EQ Credit Interior Lighting specifies for the ‘Glare Control’ strategy to “achieve a Unified Glare Rating (UGR) rating of <19 using software modelling calculations of the designed lighting”.
