I am a little confused about the deifinition of a bay as it pertains to LEED credit 8.1. Also, should i count the bays of non-compliant spaces (i.e. non regularly occupied spaces)?

No, you should not count the bays of non-regularly occupied spaces.

Per an addendum, the definition of Bay was added to this credit as "A bay is a component of a standard, rectilinear building design. It is an open area defined by a building element such as columns or a window. Typically there are multiple identical bays in succession."
