TSLA won't be ready for Design Preliminary Submission

Hi,

We are doing a LEED C&S project. We are going to submit WEp1 and WEc3 through the option of providing TSLA. Since this building just started construction, owner currently don't have a full version of TSLA that is going to be used for future tenant. But the owner is willing to provide a signed letter mentioning that they will put certain credits' requirements into the TSLA. Will this document be strong enough to be used as a replacement of TSLA for our Design Preliminary Submission? If not, what type of language will be considered as a "binding language" in the TSLA?
