Hello there!
Based on the Reference Guide Correction ID#100001102 made on 11/01/2011: "Non-regularly occupied spaces are spaces that occupants pass through, or spaces used in pursuit of focused activities for less than one hour per person per day (on average).".
Can we argue based on the definition above that tenant retail areas are non-regularly occupied spaces since users do not pursuit focused activities for more than one hour per person?

You can argue for any regularly occupied space to be excluded from the daylight and views credits. But the Regularly Occupied space matrix dated October 2013 states that Merchandise Areas, which would be retail, are to be considered regularly occupied.
Also, you will need to include the requirements for the credits in the tenant spaces in the Tenant Lease Agreement.
