We are participating in a Design-Build project of more than 20,000 ft2. Can the supervisor of the general contractor hire the Commissioning Agent? The supervisor will be employed directly by the Owner. There is no specification on the Reference Guide, Adenda, or any documentation I've been reviewing, but I would like to know if someone has experienced the same scenario. We are applying for Fundamental and Enhanced Cx.

In our experience, the CxA can be hired by people other than the owner, such as a design build team lead. We have been on design-build teams for certified projects of much larger than 20K sq. ft. As long as the Cx company is an independent company from the design team, I think that should be fine. We are often contracted directly to the architect or contractor as well for other non-design build projects.
