Occupancy from areas not in LEED scope

Hello, We are certifying a building which has undergone a major renovation above grade. It has 3 basements: basements 1 and 2 are car parks, basement 3 has technical rooms, storage and some toilets only used occasionally by maintenance staff (5 people maximum). None of the basements are part of the renovation project scope. We initially excluded basement 3 from certification. After a preliminary review, we provided a revised narrative including basement 3 areas and occupancy for water and general counts, but leaving basement 3 out of the LEED project scope. Still, we have received a new review that does not accept this. Is the problem in occupanty counts? Must we still include basement 3 in the LEED scope, even though it has not been renovated? Because LEED for New Construction and Major Renovations is a whole building rating system, you need to include the whole building within the LEED scope. List unrenovated area as such on the LEED PI Form.
