1. It appears that we are encountering a persistent issue in our projects. Many of our projects are situated in Non-Attainment areas, and we are already using MERV 13 filters for both the supply air (via Evaporative Coolers or VRF with MERV filters) and the ventilation air (through the Fresh Air fan, which has an inbuilt MERV filter). However, the response provided has not been accepted by the LEED reviewer team.
In this situation, we need to consider an alternative approach or solution to address the LEED reviewer team's concerns.
2. In some other cases, our production areas are equipped only with ventilation fans and exhaust fans, and we do not have any supply air. However, we have operable windows in these areas. So here is possible to install the MERV Filters in the fresh air fan and exhaust fan?.

- Based on your situation, you should give a depth explanation in narrative text to demonstrate that the MERV 13 in the non-attainment area is provided. If necessary, support documentation shall be given to prove that. If the option above is still not accepted by LEED reviewer team, then you may choose option 2, by confirming compliance with the requirements in CEN Standards EN 15251–2007 and EN 13779–2007 (LEED BD+C v4 guide page 611)
- If the windows have control that prevent them from being closed during times of expected occupancy and comply with Section 6.4 ASHRAE 62.1-2010, then it is included under natural ventilation exception (ASHRAE 62.1-2010 Section 6.4 requires naturally ventilated spaces to include mechanical ventilation system unless one of the exceptions applies) as stated in the LEED BD+C v4 guide page 616. Therefore, the MERV filter is not required to be installed.
