Our project is a high-rise office tower with a small podium in front of the project. Our office tower has 55 storey. The podium is open air space where has small enclosed retail and gym located inside.

The office tower has major occupancy area of this project. We provide all necessary strategies such as 30% increased outdoor air, treated outdoor air with MERV 13, interior cross-contamination prevention, and install CO2 sensor in densely occupancy area. This is to earn 2 points for this project.

The retail and gym inside the podium, we provide entryway system, 30% increased outdoor air. But we the provided outdoor air doesn't be treated with MERV 13.

So my question is, can we earn this credit without MERV 13? If no, can we put installation of MERV 13 as requirement in a binding tenant sales and lease agreement?
