Can one exclude a new ECM motor that doesn't comply within an existing fan box unit where a compliant motor doesn't exist or is infeasible? All new fanboxes and motors will comply. Wanted to know if this is a repair existing or there isn't such a thing?
If we leave it alone, but it's within the tenant space, but not in scope, is that okay or are you required to exchange everything inside your space?

You shouldn't have to change it. Especially if it's outside your scope of work (which it sounds like it is) you're not required to make it conform. However, if you were making some other change to that fan box, and not upgrading the motor, then you'd be in trouble.
Simple rule for C&I is: If you're touching it, you need to make it meet LEED requirements. If you're not, you don't.
