In multi-family residential units, can a VTAC unit provide mechanical ventilation to meet 62.1-2010?

The operable windows provide natural ventilation, but ASHRAE now requires mechanical ventilation for when the windows are not open, and that makes sense.  A project in concept stage intends to use electric powered VTAC - vertical terminal air conditioning (and heating) - with direct outside air management through louvers and interior connection to return air.  Each unit will have thermostatic control.  So, would the VTAC unit have to run continuously as a ventilation only system when not calling for heating or cooling?  Would that conform to the intent of LEED? 

I can imagine an interlock between the VTAC control and the operable window that would turn off the fan if the window is open, but that approach may be costly and not fully reliable.
