Mixed Use Building Residential + Commercial

We are working in a project for which we will be pursuing LEED NCv2009. It is a mixed use (residential and commercial) building. However the commercial areas will be treated as a shell for future tenants. The owner wants to proceed everything as part of one rating (NC) therefore I was wondering if there is submetering required for future tenants, or if it can be satisfied by having a letter from the owner saying how future tenants will treat their spaces to keep the certification in place? Thanks.

There are no submetering requirements at all for this credit. The submetering of tenant spaces by fuel type will likely not produce much useful information for the M&V Plan. A letter from the owner would not be sufficient to document any potential outcomes related to the tenant spaces. The only documentation acceptable for changes would be a lease agreement that requires the tenant to make a certain change of follow a particular performance metric. You will need to account for how you will calibrate the energy model for the entire building including the tenant spaces within the M&V Plan. During design you should be thinking about how you will be gathering the data you need to calibrate the energy model from the whole building including the tenant spaces. In order to implement the M&V plan the tenant spaces would likely need to be occupied.
