The minimum occupancy requirement is 50%. This can be found in the LEED 2009 MPR SUPPLEMENTAL GUIDANCE, issued by the USGBC in November 2009.

One exception is that for hotels, currently LEED and Energy Star's minimum occupancy requirements are both 55%. This is also noted in the USGBC document.
