We recently received a comment from USGBC LEED that we have to meet ASHRAE 90.1 COP requirement in proposed case energy simulation as well. However, we got approval for several projects in past without this COP criteria in proposed case.
Can we model proposed case chiller COP at ARI condition lesser than ASHRAE Standard 90.1-2007, Table 6.8.1C. Kindly, please advise on the same.

Short answer is no.
Everyone needs to realize that just because something was approved on a previous project it does not mean that it will always be approved on subsequent projects. Not all issues are identified on every review. This is like saying I got away with speeding on the highway dozens of times before so why are you giving me a ticket now?
The system efficiency of the equipment installed in the project is a mandatory provision of 90.1. LEED requires that all mandatory provisions must be met in order to meet the prerequisite for minimum energy performance. So you can model it below the required minimum efficiency but this provision is not avalable for trade-off since it is mandatory. Only the prescriptive requirements of the standard are available for trade-off.
