Yes, I have been able to get equipment accepted by showing to would be able to meet Energy Star requirements in Energy Star labeling was available. You would need to provide a comparative analysis of the equipment specs to the Energy Star standard and you would have to show that Energy Star labeled equipment is not available. You are most likely going to have to go through a project specific CIR though.
