We are working on a project that includes a building and open space surrounding it. Part of the open space is a vegetated area that the project owner is developing but that will be transferred to the municipality when finished. The team would like to count that vegetated open space as part of the LEED Boundary in order to achieve certain credits such as SSc5.1, and SSc6.2 among others. Is that possible, even though ownership of that area in the future will change hands? Thanks for your help.

That is only possible if the Municipality will guarantee that the open space will be preserved for the life of the building. If they have plans to develop it, then you cannot count it towards credit compliance for SSc5.1 and SSc5.2. The stormwater credits are a little different in that they allow some circumstances where stormwater runoff can be collected offsite. You might check that page for more info.
