Lease language

WE have a core and shell building, the owner signed one tenant without lease language. Can we include the lease language for the rest, just not that one? Code here is IECC2015 which is stricter than the LEED baseline. They are required to meet that, can we use the code improvements for the area without lease language, take that small boost?

MKK, Are you claiming any savings for certain measures beyond the baseline from the tenant spaces? If you are, then a binding Tenant Sales/Lease Agreement is a requirement for all tenants. The Appendix G modeling protocol addresses the whole building performance and I don't think GBCI will accept inserting components from another standard, even if it is stricter than the ASHRAE 90.1 baseline. Only savings for measures that are designed and installed as part of the Core and Shell building can be claimed, unless the measures are specifically required in a binding lease agreement without exceptions for all tenants.

MKK,  How did it turn out? Were you able to utilize more stringent code requirements in the energy model, or did you also have to implement a binding lease agreement? We are having the same question on a current CS project...
