I see some threads on this issue but want to re-open this conversation. We have CI projects that are in buildings that have executed leases with a 10 year duration. However, the projects are happening at different times during the duration of the lease. In other words, the renovation or build out of the space does not coincide with the beginning of the ten-year lease. Per Tristan's post of Dec 18, 2011, he believes that is the intent of this credit.
However, in the 2009 reference manual, it says "The credit requirements are satisfied when the project area is either owned by the occupant or is currently included in a lease with a term of no less than ten years." And then further, "The requirement does not stipulate a relationship between the start of the lease period and the project construction activities". These statements suggest to me the opposite.
Our projects are included in leases that have terms of no less than ten years, whether those terms started in 2007 or they started in 2013. Has there been a more recent addendum or LI that I missed that addresses this? Has anyone received review comments that clarify this issue?

Yes, thanks. We have a lease, and its duration is 10 years. But our project TI construction is halfway through that 10 year duration period. Some of the answers below seem to indicate that you should be in the space 10 years after certification. As if duration needed to be coincident with the completion of construction. I will go with the reference manual statements above. Our project is included in a lease with a 10 year duration, and there need not be a relationship between the start of the lease and the construction activities. Thanks.
