Should the penthouse be included in the gross area used to calculate the flush out volume? Also, does it have to be specific on a system by system basis, such as the area of the floor served by certain units?

I have always documented this credit on a system by system basis. I think it makes sense because each system will take a different length of time depending on the fan airflow and the square footage to be flushed.

Regarding the penthouse, if it is an occupiable space, I think you do have to cover that area in your calculations.

in LEED world, the floor area listed in the Details page should be used in the flushout calculations.
