Getting access to building energy data

We've been doing some work gathering actual energy data on our recent projects. (In January we actually issued a report on 21 public buildings ). 

One of the biggest issues is getting access to the actual data - many clients don't want to share. 

Has anyone crafted proposal or contract language allowing/requiring design team access to the owner's data?

Did it work? Can you share the language you used?

I haven't encountered much data sharing resistance, when we ask for it, so that's interesting... is there a concern on disclosure or privacy with regard to performance? Or some other security concern? 

People willingly sign away sharing of data to USGBC as part of LEED certification (also not something I've encountered resistance on) but feel like proposal / contract language 'requiring' clients to share data would be off-putting for some.  What I feel has worked best personally is offering a 'free training' type of session on Portfolio Manager for whomever the Owner's identified parties are. Translating the data we want from the utility bills into PM, and then having them set up a connection request with our account as read-only. That way they feel in control of their data, and we get what we really want (information without too much additional effort to track it down).

I guess the issue is that we are subconsultants. So our direct clients (typically an architect) don't like us reaching out to their client (the building owner).  We've also found that many owners sign the LEED data sharing agreement but don't bother to actually share the data.
