NC-2009 IEQc8.1:Daylight and Views—Daylight

Excluding regularly occupied areas

We have some projects in which regularly occupied spaces are designed with no-windows because of client's requirements. These are process areas (a kitchen and a laboratory). Are we allowed to exclude these spaces from calculations? Thanks

Referencing the EQ Regularly Occupied Space Matrix, Kitchens that are multi-occupant and considered regularly occupied (more than 1 hour of occupancy a day) then it must be included. The same with Laboratories. However, with labs, a narrative explaining what type of activity goes on in there and how daylight would cause problems is acceptable. There really isn;t a reason for a kitchen to not have daylight. Burying it in the core of the building or poor space planning is not an excuse.
