For projects under 50,000 sf, can the HVAC engineer and commissioning agent be the same person?
Obviously not best practice but strictly speaking, is this allowable?

Matthew, the CxA requirements are covered under our Checklists tab, under Design Development.

We have a project that has organically grown, and went beyond the 50000 sf mark only by 3000 sf. The Cx Agent of our office had already started on commissioning task and only recently we were able to set on stone the boundary. Do you think USGBC are super strict about it?

It's possible they would allow some leeway, but because the 50,000 SF figure is printed in black and white I would clear it with direct contact with GBCI. And I would guess they might not be willing to make the exception. It's not GBCI's style to round numbers down or up.
