We are participating in LEED CS v2009 certification in an office building.
This project consists of changing the HVAC system in the building.
During the remodeling, this building was occupied by a tenant which is not participating in the certification.
Before the remodeling, this tenant had a Data Center, UPS and cooling systems.
And he has kept these equipments after the remodeling.
The building owner is not responsible of these equipments.
Is it mandatory to include the energy consumption associated to Data Center, UPS and cooling systems in the energy simulation?
If so, would it be necessary to include it as Process Energy (both in baseline and in proposed)?

Yes it should be included and yes it considered a process load.
