Our Design Team is asking to the Contractor to track and collect recycled content data for site's drainage piping which is included in Division 33 for CSI MF 2004. Do we need to submit a CIR to make sure reviewers will accept this inclusion or should we directly include/exclude this Division from the calculation? Seems the credit does not really apply to this material's category.

Basically, are "DIVISION 33 - Utilities" considered as MEP components (or as special equipment) and so are they excluded from both total construction cost and recycled content calculation? Otherwise, may it depends on the proposed project case?

There is already a Credit Interpretation Ruling on this which says MEP and special equipment may be included; sorry I do not have the number right now, but I can post it tomorrow if no one else does.

Clarification: the Interpretation is #10409 and appears to apply to Option 1 of the three BPDO Credits. The interpretation stated that "...if these products are included in Option 1 of a credit, they are not REQUIRED to be included in Option 2." I am not sure, but It sounds to me like the utility piping could be included in Option 2; Recycled Content.

Seems you are basing your analysis on the latest LEED v4, though this version no more refers to Master Format requirements.
Also, the Credit Inquiry and ruling within LEED Interpretation#10409 addresses Divisions 11-28 , while for MasterFormat 2004, which is required for NC v2009, storm drainage piping components are included in Division 33, and are basically excluded from total construction cost and materials cost calculations.
I found this comment from Jon Clifford in a previous topic, which is very useful to me.
The original topic issue is to include or not hardscape, sanitary/storm components and landscape materials in the LEEDv2009 total construction cost calculation.

However, LEED-2009 cites MasterFormat-2004, which classifies into 50 Divisions using 6-digit designations. Division 02 is now called “Existing Conditions,” and covers activities such as demolition and site clearing, “Special Foundations and Load-Bearing Elements” have moved to Division 31, paving, site improvements, and planting to Division 32, and utilities to Division 33.
In LEED-2009, Materials and Resources Credits MRc3 through MRc7 calculate the costs and contributions of materials normally specified in MasterFormat-2004 Divisions 03-10, Foundations Sections 316000-316999, Paving Sections 321000-321999, Site Improvement Sections 323000-323999, and Planting Sections 329000-329999."
Seems the project LEED version's Reference Guide is the most stringent guideline ruling on this Credit.
Despite this, the Design Team requires recycle content rates for these Utilities from the Contractor . Are they wrong or is their approach viable?
This may depend from the actual Green Building's interpretation of MR Credits, more comprehensive and extended than the outdated LEED 2009 version, but are reviewers allowed to follow updated guidelines other than specified Reference Guide's requirements?
