Hello,
"X" was appointed as third party CxA by the owner, since the start of the project. The mechanical contractor is now proposing the same company "X" as a third party Testing and balancing agent, appointed by the mechanical contractor. Is this allowed or there is a conflict of interest?

There are quite a few commissioning firms that have in-house testing and balancing. In this case, I do think there is the appearance of a conflict of interest, however, I do not feel that there is anything in the standard that would not allow this. The best option, in my opinion, would be to have the MC offer a change order reduction in the amount of the contract for T&B and have the owner pick that up in their contract with the CxA.
