It seems clear but, to be certain, can a core and shell project have an occupancy of less than 50%? I have a project that wants to go New construction but, I think this MPR5 will keep them from meeting the min req. for NC and I think the only option is to go Core and Shell. Only the first floor is built out and occupied even thought the entire building is renovated. The other floors are simply core and shell. HVAC is treating the upper floors as unoccupied.

Review the 40/60 rule in the rating system selection guidance document. New Construction projects that will be less than 50% occupied are recommended to pursue LEED for Core & Shell. Also, if the renovation already occurred the building may need to pursue LEED for Existing Buildings. However if it is less than 50% occupied on a time weighted average over 12 months you are not able to pursue LEED for Existing Buildings.
