Requiring tenants to include base building toilet fixtures in their calculations will ultimately discourage some tenants from pursuing LEED. We have recently renewed our lease and intend to pursue LEED Gold for our new space build-out. Unfortunately, we have no control over the base building plumbing fixtures. Since we are committed to a "green" design, we will still pursue whatever points we can, even if we are unable to obtain LEED certification because we can't meet this pre-req.
Less committed tenants may decide that a green design is not worth the effort if they have no chance to obtain certification. What a shame.

Per the 7/2010 Addenda, the project is exempt from WEp1. It sounds like the project would fall under “Case 4” of the Water Use Reduction Additional Guidance document (updated August 16, 2010) since there are plumbing fixtures both within and outside the tenant space. Under Case 4, the project will not be able to claim any water savings under WEc1. Essentially, the Addenda and additional guidance allow your project to pursue LEED certification without worrying about the plumbing fixtures outside of your tenant space, but do not allow claims of water savings on the limited fixtures within the space. In any case, I’m not sure that an ultra-low flow lavatory would have achieved enough water savings on its own to meet even the lowest threshold for WEc1.
