Our site is brownfield (existing navy base), but the site is being graded before 1980 to be prepared as industrial area. The current construction activity start at 2014. Can we still consider our site as brownfield since its graded before the construction started?

Michael, given the fact this project was designated as a brownfield site and subsequently graded before 1980, are you certain the contamination was not removed during the grading operations? And if the contamination was removed, was it done properly and recorded by a qualified professional such as an environmental engineer? The primary concern should be removing any and all liabilities related to developing a brownfield site. Aside from the LEED credit, as the owner or contractor, I’d want to be certain that the site is or is not a brownfield by having an ESA performed, and then acting accordingly. In my opinion, without proper documentation, you’d have difficulty being awarded the LEED credit based on hearsay evidence. Brownfields require confirmation of contamination and verification of remediation.

Hi Larry, We believe the contamination was removed during grading operations by the local government. Hence this site is considered as graded site.
