I think you could. I just finished my LEED project (Certified) I had one denied credit in Preliminary construction submittal and I have resubmitted with Final construction submittal . it got approved.

Yes you can. An appeal and the remainder of the construction review are separate submissions. You can submit an appeal at anytime.

My question is along those lines. I am working in LEED v2.2, and have the results of the Final Design Credit. To move onto the Construction Phase in V2.2 I have to click on something to accept the findings of the Final Design Credit. In accepting the results (including the denial of a particular credit), does that negate my ability to put in an Appeal later? (I didn't know if v2.2 or v2009 worked any differently.) Thanks

Marcus, you say "You can submit an appeal at anytime" but GBCI says "Any denied credits can be appealed either after the final design review or after the final construction review." I have a project under preliminary construction review and I am unable to click the any buttons to submit a design credit appeal. If there is a way to submit before the final construction review, please let me know.

There may be some logistical reason within LEED Online that you can't do both at the same time. Contact GBCI through the Contact Us on their web site. I am sure they would be happy to arrange to receive your appeal if you cannot do it through LEED Online.
