Active Controls with a Fan Coil Unit System

For a Fan Coil Unit system, with outdoor air being provided adjacent to the rear of the unit will the outdoor fresh air rate (from the main AHU) need to modulate to qualify as "active control" or is it enough for the fan coil unit to switch off the heating / cooling and ramp down to its lowest speed setting. I have read both CI 10242 and 10263 and I am still unsure of the minimum requirements.

As I read it you need either DCV or occupancy sensors. If your system switches off and runs at low speed based on occupancy it sounds like it might qualify.
