The base building HVAC system uses 100% outside air. Therefore there are no return grilles. I am assuming that the requirement for filtration then is not applicable?

If there is not a way for contaminants to get back into the ventilation system, you would meet the intent, and I would assume you are right. However, I'd prefer that mechanical engineer answer this question.

That's correct for this credit - but you'll also need to meet the ASHRAE standard minimum of MERV 6 before a cooling coil (if applicable). IEQp1 requires that you meet ASHRAE standards.
I'd recommend MERV 8 anyway - they are practically as cheap and similar pressure drop.
