Municipal law requires that our building be completely smoke-free inside. It also bans smoking next to the building, but it’s not as stringent as the 25 foot LEED requirement. Do we have to make another policy that bans smoking within 25 feet?

Spaces used for business purposes

Our project is an existing building, that is to be renovated in large parts and converted fron retail to office ues.

The first floor of the building will not be changed by the construction measures. in first floor there is a cafe with an outdoor area, located outside the LEED boundary, on the other side of the sidewalk. Parts are located within 7.5m distance of buildings openings. 

In order to comply with the prerequisite, must prohibiting smoking also be enforced for the existing outdoor area, or can an amendment to the existing lease agreement be waived in this regard?

Hi Andreas,   No, you can’t. In the LEED guide, there is clearly stated about the smoking prohibition in outdoor areas used for business purposes. A business that uses a public sidewalk or courtyard for seating or kiosks still maintains control over those areas, even though they are typically outside the property boundary line. They are included under this prerequisite because the business owner still has control over the smoking policy in these areas. You may see these requirement in the “Behind The Intent” part and “Step-by-step Guidance” step no.3.   Thanks and regards.
