Smoking in a casino floor of a hotel on Native American Land

I am running into an issue pursuing LEED certification due to this prerequisite for a hotel with a casino, but I saw a comment about a code caveat that poses an interesting opporunity for our project. It is on Native Americal land ("indian reservation"), and does not have a code to follow for smoking. Please advise if this could be an exception.

I am not so sure that demonstrating local code allows smoking will allow prereq compliance. Recently I had a similar situation with the ventilation prereq on a 25-story residential building. The local code does not require ventilation for the corridors serving the residential units, so I tried to demonstrate to USGBC that the project met the local ventilation code and hence should demonstrate prereq achievement. USGBC did not allow me to use this path.

What code caveat are you referencing, I would be interested to know more about it?  Many of the LEED requirements are above and beyond an established code, or have compliance paths if a code/regulation isn't in place (like no requirements for open space, parking spots, etc), so don't know how you could get around that.
