If a project uses an ERV or HRV to provide bathroom exhaust, is it exempt from EQ 5.1 (d), which requires all bath exhaust fans to be ENERGY STAR labeled? There are no ENERGY STAR labeled ERV/HRV systems.
Ruling
Yes, if an ERV or HRV is used to provide bathroom exhaust, the requirement for Energy Star certification is waived. This exemption will expire if and when EPA begins labeling ERVs and HRVs.
